The A/C is fully charged and blows strong and cold if the relay to the compressor is bypassed, but will not engage under normal conditions. Repair for this is very likely a new Trianary Switch (approximately $70 part, A117P0059F) and would require the vacuum and recharge of the A/C system to install. Additionally, the air diffusion selector is not functioning and the air currently is only coming out at the footwell (good for heat).The remote door locks and alarm system have been disabled on the car. I felt it was too sensitive and produced too many false alarms (thunder would set it off). It may be simple to reengage these features, but I cannot confirm that they still work. However, the locks do work with the key manually. The electronic ignition disabling functions properly from the key fob as well.The tires still have good tread depth but will need replaced due to age. The Ugly: After 13 years, the paint is less than perfect. The car is not and was not garage kept for most if its life. The paint has faded at spots and there are several areas that have minor cracking, chipping, or bubbling. Both doors have warping near the tops from the sun hitting the mirror and reflecting onto the doors. and I have provided photos of the most noticeable. These are all quite small, but I want to mention all flaws as much as possible. I am including a bottle of factory touch-up paint as well.The alloy rims have some pitting/chipping caused by road debris, and some curb scuffing. Again, I have included a photo of the worst one, but the damage is minor.The first-year model suffered from a design flaw in the headlamps that magnified the sun’s light, allowing the inside of the lamp housings to be melted by the sun. Both headlights on this car have this damage to some degree (see photos) but it does not impede the use of the headlights in any way.The trim/fitment rings for the dash speakers have deformed/melted from the suns heat, and cracked in several places. Photos included.The soft top fabric has shrunk a bit over the years causing a fitment gap. This is cosmetic only and the top functions and seals properly without leaks. Limitation of Liability - SELLERS LIABILITY FOR ANY LOSS OR DAMAGE ARISING OUT OF OR RESULTING FROM OR IN ANY WAY CONNECTED TO THIS TRANSACTION OR THE AUTOMOBILE CONTEMPLATED BY THIS TRANSACTION SHALL NOT EXCEED BUYERS PURCHASE PRICE, REGARDLESS OF WHETHER SUCH LIABILITY ARISES IN CONTRACT (INCLUDING, BUT NOT LIMITED TO, FAILURE OR DELAY IN PERFORMANCE OR DELIVERY DUE TO ANY CAUSE WHATSOEVER), TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE OR STRICT LIABILITY) OR OTHERWISE. IN NO EVENT IS SELLER RESPONSIBLE TO BUYER FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, ALL DIRECT OR INDIRECT COSTS, REGARDLESS OF WHETHER THOSE DAMAGES WERE FORSEEABLE. ANY CLAIM BY BUYER SHALL BE DEEMED WAIVED UNLESS PRESENTED IN WRITING TO SELLER WITHIN THIRTY (30) DAYS FROM THE DATE BUYER TOOK POSSESSION. 6. Force Majeure - Seller shall not be liable for failure or delay in performance hereunder due in whole or in part to (i) acts of God, (ii) strikes, lockouts, or other labor disputes, (iii) civil commotion, sabotage, fire, flood, or explosion, (iv) acts of any governmental agency or authority, (v) unforeseen circumstances (vi) inability to obtain or delay in obtaining any necessary governmental approvals, permits or licenses, (vii) mechanical failure, (viii) or any other cause which is not within the reasonable control of Seller, whether or not of the kind specifically enumerated above. 7. Choice of Law, Jurisdiction & Venue - The transaction to which this document relates shall be governed by the substantive laws of the Commonwealth of Pennsylvania. In the event of any dispute between the parties arising out of this transaction, the parties agree and consent that the exclusive jurisdiction and venue for the resolution of such dispute shall be Pennsylvanias Court of Common Pleas, Montgomery County, or the United States District Court for the Eastern District of Pennsylvania. 8. Notices - No notice or other communication is sufficient to affect any rights, remedies or obligations of either party unless the notice or communication is in writing and (as elected by the party giving the notice or communication) is (i) personally delivered, (ii) transmitted by facsimile (with a receipt acknowledgment), (iii) transmitted by electronic computer mail, (iv) transmitted by a recognized courier service or (v) mailed in registered or certified form, to the party to which notice or communication is being given. Notice shall be delivered to the address specified below. 9. General - In the event that any provision contained herein is held to be invalid or unlawful, such provision shall be severed from the remaining provisions, which shall remain in full force and effect. No waiver of any provision hereof and no single waiver shall be held to constitute a continuing waiver or subsequent waiver. We accept payment via PayPal (Deposit ONLY), money order, bank check, certified check, cashier check or wire transfer for remaining balance. Personal checks, PayPal and credit cards are NOT accepted for balance. A non-refundable deposit of $1000 is due within 24 HOURS of auction’s close on transaction under $35,000 and a $2,000 non-refundable deposit is due within 24 HOURS of auction’s close on vehicles $35,001 and up. Remaining balance to be paid within 3 DAYS of the close of the auction, or vehicle will be put back on market and deposit will be forfeited. Fees and Taxes Buyers Located Outside of Pennsylvania: A FEE OF $175.00 WILL BE APPLIED TO THE WINNING BID FOR OUT OF STATE BUYERS. THIS INCLUDES A 60-DAY TEMPORARY TAG, 60-DAY TEMPORARY REGISTRATION, PA DOCUMENT FEE, AND PA REGISTRATION ONLINE PROCESSING FEE. WE WILL ALSO COLLECT THE NECESSARY SALES TAX AND LICENSE PLATE FEES FOR THE STATE IN WHICH THE VEHICLE WILL BE REGISTERED. PLEASE KEEP THIS IN MIND WHEN BIDDING! WE ARE REQUIRED TO COLLECT TAX & TAGS FROM THE STATE OF REGISTRATION IF THE VEHICLE IS BEING FINANCED! Pennsylvania Residents: IN STATE BUYERS ARE REQUIRED TO PAY SALES TAX, REGISTRATION, TITLE AND DOCUMENT FEES. CALL FOR EXACT FEES.
