No contract exists between you and Hennessy to purchase the car until you pay the Deposit called for in section 2 below. Within twenty-four (24) hours of the end of the auction or making a “Buy it Now” bid, you must deliver to Hennessy a deposit (the “Deposit”) equal to ten percent (10%) of the auction price. In the event that you fail to close on your purchase of the car after paying that Deposit, Hennessy shall be entitled to retain the Deposit as liquidated damages for your breach and not as a penalty.
